These Terms of Service govern your access to and use of the products, services, website, and platforms operated by Auriya Living, a bespoke lifestyle brand operating under Auriya. By accessing, browsing, or purchasing from Auriya Living, you agree to be bound by these Terms of Service.

If you do not agree to these terms, you must refrain from using our services.

1. Definitions

"Auriya Living," "we," "us," or "our" refers to Auriya Living and its parent entity Auriya, including affiliates and subsidiaries operating within the Gulf Cooperation Council.

"User," "you," or "customer" refers to any individual or legal entity accessing or using our services.

"Products" refers to all goods offered for sale, whether physical or digital.

"Services" refers to all lifestyle, concierge, advisory, and ancillary services provided by Auriya Living.

2. Eligibility and Legal Capacity

You must be at least 18 years old or have legal capacity under applicable laws of your jurisdiction to use our services. By using Auriya Living, you represent that you have full authority to enter into legally binding agreements.

3. Scope of Services

Auriya Living offers curated lifestyle products and bespoke offerings. Availability may vary by location and is subject to change without notice.

We reserve the right to modify, suspend, or discontinue any product or service at our discretion.

4. Orders and Acceptance

All orders placed are subject to acceptance by Auriya Living. We reserve the right to refuse or cancel orders for reasons including but not limited to availability, pricing errors, suspected fraud, or regulatory restrictions.

Order confirmation does not constitute final acceptance until dispatch or service commencement.

5. Pricing and Payments

All prices are displayed in the applicable local currency unless stated otherwise and may be subject to taxes, customs duties, or fees in accordance with UAE and GCC regulations.

We reserve the right to change prices at any time. Payments must be completed through approved payment gateways. Auriya Living does not store full payment card details.

6. Delivery and Risk Transfer

Delivery timelines are estimates only. Risk of loss transfers to the customer upon delivery, unless otherwise required by mandatory consumer protection laws applicable in the UAE or GCC member states.

Customs clearance delays are beyond our control and do not constitute breach.

7. Returns and Refunds

Returns and refunds are subject to product type and applicable consumer protection laws. Bespoke, customized, or made to order items are non refundable unless defective or required by law.

Any approved refunds will be processed using the original payment method within a reasonable timeframe.

8. Intellectual Property

All content, designs, trademarks, logos, product descriptions, and materials are the exclusive property of Auriya Living or its licensors.

No content may be copied, reproduced, distributed, or exploited without prior written consent.

9. User Conduct

You agree not to misuse our services, engage in unlawful activities, submit false information, infringe intellectual property rights, or attempt to interfere with platform security.

We reserve the right to suspend or terminate access for violations.

10. Privacy and Data Protection

Personal data is collected and processed in accordance with applicable UAE data protection laws, including Federal Decree Law No. 45 of 2021, and relevant GCC regulations.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Auriya Living shall not be liable for indirect, incidental, special, or consequential damages arising from the use of our products or services.

Our total liability shall not exceed the amount paid by you for the relevant product or service.

12. Indemnification

You agree to indemnify and hold harmless Auriya Living from any claims, damages, losses, or expenses arising from your breach of these Terms or misuse of our services.

13. Force Majeure

We shall not be liable for failure or delay in performance due to events beyond reasonable control, including acts of God, governmental actions, supply chain disruptions, or natural disasters.

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates. Where applicable, disputes shall be subject to the exclusive jurisdiction of the courts of the UAE, without prejudice to mandatory consumer rights under GCC laws.

15. Amendments

We reserve the right to update these Terms at any time. Continued use of our services constitutes acceptance of the revised Terms.

16. Severability

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.
